TERMS AND CONDITIONS

ORDERS
1. The prices listed on the site include VAT. The amount of VAT is in force at the time in Spain, the country in which there is the name of the company.
2. To prevent errors, all orders must be made online, or by writing an e-mail or fax.
3. You cannot combine orders for items with orders of the outlet store items, since the latter are in a special promotion. If you are interested in Outlet products, it is necessary to carry out an order that includes only the Outlet products. For Outlet products, we do not accept returns or exchanges.
4. Within 48 hours, you will receive confirmation of your order and email proforma invoice with the delivery date, final amount, the list of products, colors and finishes, etc. It is essential to check the order data, because any following reloading caused by an error in the order is the responsibility of the customer.
5. The minimum amount of an order for the Canary Islands is 500 €. In these cases, the prices stated in the bill appear without VAT. The customer must pay the corresponding taxes (IGIC) when receiving the order.
6. The deadline to cancel an order is 4 days from the date of confirmation. After that date, the deposit will be forfeit in its total. This clause does not apply to the exercise of the right of withdrawal.
7. The booking of stock products are valid for 6 days at the most. After this deadline, the reservation will be canceled and the customer will lose any payment deposited. For products without storehouse, this six-day period begins to run from the date on which the Ma®Te articles are available.
8. In the case of orders of sold out articles, Ma®Te will make the article in question below specific request, there will be no possibility of cancellation or modification with any circumstances. The customer must pay 100% of the price, recognizing that Ma®Te must pay its providers for the materials. This clause does not apply to the exercise of the right of withdrawal.

DELIVERY
1. We deliver in Spain, Portugal, Germany, Belgium, France, Holland, Italy, Luxemburg, Mónaco, UK, Denmark, Finland, Greece, Liechtenstein, Norway, Sweden, Switzerland, Canada y EEUU. Other countries: contact us.
2. The delivery times are indicated on our site. These periods shall start from the moment Ma®Te receives payment and can make the invoice of the order.
3. The customer is charged for shipping costs.
4. Ma®Te does not deliver to the Canary Islands for orders less than 500 €. All goods entering the islands must be declared at customs. Ma®Te carries out the packaging for the export, and this is included in the shipping.
5. The customer must indicate the important data for delivery. Customers are charged for any other fees required to access the delivery address.
6. Contact your service representative to verify the exact dimensions of a product before ordering.
7. The prices do not include installation of elements that require it.
8. The material is delivered perfectly packed and protected inside its box. If for any reason you order the unpacking of the product before it reaches the final destination, Ma®Te is not responsible for any damage caused.
9. The delivery times shown on our website are approximate.
10. Ma®Te Design 360 SL is not responsible for any delays caused by transport, as the dealer is an external service over which we have no control. All claims will be made directly to the dealer. At the time of the purchase, the customer should be aware that shipping and delivery is out of Ma®Te supervision.

PAYMENT
– Payment method: credit card (Visa, Mastercard, American Express) or Pay Pal.
– For special orders or items that are not in stock, the customer must pay 100% of the invoice when ordering.
– The maximum reservation of products in the storehouse is of 6 days.After this deadline, the reservation will be canceled and the customer will loose any payment deposited.
– In the case of orders of sold out articles, Ma®Te will make the article in question under specific request, there will be no possibility of cancellation or modification under any circumstances. The customer must pay 100% of the price, recognizing that Ma®Te must pay its providers for the materials. This clause does not apply to the right of withdrawal.

RIGHT OF WITHDRAWAL
The customer has the right to cancel any acquisition, without justification, within 7 days from the day calendar in which the customer or a third party indicated by him, receiving the article, other than the dealer. To exercise this right, you must notify your decision to the recession of the contract before it expires, by e-mail or by phone:

Whit the below I inform you that I request the recession of my purchase contract of the ordered product / s (name, reference and quantity of the product that you want to cancel).
Indicates the data in the following order:
– Order number.
– Customer Name and Last Name.
– Address of delivery of the order
– Date and signature.

In case of withdrawal on his part, we will refund all payments except the shipping, the pay back will be made within 14 days of calendar, starting from the date of the recession of the sales contract.

We will refund using the same payment method used for the initial transaction, unless otherwise specified. In any case, it will not incur any fees because of such return. It may withhold reimbursement until it has received the products, or until you have no proof of that refund.
To make the return, follow the instructions in the “Returning” of our website. In any case, the customer must return the items to Ma®Te on their own. Ma®Te not be responsible for the article if the customer uses other dealer.

The customer pays the shipping costs of returning the products. The decrease in the value of the returned products, which undergo manipulation to establish the nature, characteristics and functioning of the damage, will be charged to the customer, and should reward Ma®Te for damages.

FAULTY PRODUCTS OR ERRORS IN ORDER
1. If there was an error in your order or if you have received an item that is faulty in the factory, you can claim the article within 7 days of calendar to receipt of it, by writing an email to: info@marte360design.com.
2. During the term of 7 calendar days, the customer must keep the original packaging of the product in perfect condition. Without this, Ma®Te not accept returns.
3. If the imperfection is caused by breakage (bumps, scratches, etc.), if you see the package in bad condition must indicate this on the carrier’s delivery note. Otherwise, if you put your signature on the receipt of the carrier you have given yours express agreement to the delivery, the transport company will not be responsible for any damages of this kind.
4. You should indicate if a product is not on the delivery note. Otherwise, the carrier is not responsible for errors in delivery or loss of goods.
5. In the event of damage during transport, within 24 hours of receipt of goods, you will have to notify the damage to the Department accidents: info@marte360design.com. All shipments have insurance that is valid up to 24 hours after delivery.
6. Send the pictures of the product and packaging by e-mail, so that it is visible damage or malfunction. If there are no photographs documenting damage will be difficult to find a solution to the problem.
7. The replacement of the faulty product or the correction of an error in the order obtained by Ma®Te does not involve additional costs for the customer. If you do not accept the replacement or correction, the customer must pay for the transport to return the merchandise.
8. In case of return for any other reason than fault of the product or an error of the order, the customer must pay the transportation costs to return the goods.
9. In any case, we only accept returns of products that have not been installed or used, and with the original box and packaging in perfect condition.
10. Once Ma®Te received the goods for return, will check the state of the damage and will proceed to the return of the customer’s payment, if applicable.
11. The descriptions of all the site’s articles contain measures and colors of the product. These figures are approximate and do not fit 100% to reality. If the customer needs to know exactly these features, please contact our Technical Service. Transport costs made due to technical reasons of this type are charged to the customer.

RETURNS
The right of withdrawal does not apply to orders belows:
– Product manufactured and characterized by customization.
– Products that can deteriorate or expire rapidly.
– Sealed products, which are not suitable to be returned for the protection of health or hygiene reasons, once the seal has been removed.
– Products out of the catalog or not in stock, products from Ma®Te under specific customer request.
In any case, we only accept returns of products that have not been installed or used and which retain the original packaging in perfect condition.

GUARANTY
1. All products are guaranteed for 1 year from the date of the invoice, only in the case of manufacturing defects.
2. The guaranty ensures the replacement or repair of this article, as many times as necessary at no cost, but does not offer a refund of the full amount paid within the last seven days of delivery.

DIVERGENCES
In the case of any divergence originated from the breach of any of the purchase-sale conditions, both parties will be subject to a judicial process in the Madrid Jury or Court, giving their own up.

RECORDING DATA
In order to provide the service, the user must register on our site. Your data will be stored in an automated database server in Spain. This information will be treated complete confidentially and only for administrative and operational use.
